Introduction

AR Buildings GmbH ("AR Buildings", "we", "us", or "our") is a professional digital visualization studio headquartered in Berlin, Germany. We offer services including augmented reality experiences, 3D architectural renderings for exteriors and interiors, virtual staging, floor plan design, drone photography, and 360° virtual reality tours (collectively referred to as "Services").

These Terms and Conditions ("Terms") govern your access to and use of our website at www.ar-buildings.com and all related services, software, and offerings. Please read these Terms carefully before using our Services. By accessing or using our Services — including visiting our website, placing an order, or engaging us for a project — you agree to these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you may not use our Services.

1. About Our Services

AR Buildings GmbH provides professional digital visualization and media production services, primarily for clients in the real estate, architecture, and construction sectors, as well as for private individuals. Our Services include, but are not limited to:

• 3D architectural renderings and visualizations of exteriors and interiors
• Augmented reality (AR) applications and interactive visual experiences
• Virtual staging of residential and commercial properties
• Floor plan design, redesign, and digital optimization
• Drone photography and aerial imaging
• 360° virtual reality tours and panoramic imagery
• Other visual media and related services as individually agreed

The specific scope of work, deliverables, timelines, file formats, and pricing for each engagement are set out in a written order confirmation or project agreement between AR Buildings and the client (a "Project Agreement"). In the event of any conflict between these Terms and a Project Agreement, the Project Agreement shall prevail with respect to that specific project.

2. Registration and Account

To access certain areas of our website or to place orders, you may be required to create an account. You agree to: (a) provide accurate, complete, and current information at registration and keep it up to date; (b) maintain the security and confidentiality of your login credentials; (c) not share your account with third parties; and (d) notify us immediately at info@ar-buildings.com if you become aware of any unauthorized access to or use of your account.

You are solely responsible for all activities carried out through your account. AR Buildings shall not be liable for any loss or damage arising from unauthorized use of your account where such use results from your failure to take reasonable security precautions.

To enter into a binding agreement for our Services, you must be at least 18 years of age and have full legal capacity to enter into contracts in your jurisdiction. By using our Services, you represent and warrant that these conditions are met.

If your account is suspended or terminated due to a breach of these Terms, you may not register a new account without prior written consent from AR Buildings.

3. Services and Deliverables

3.1 Scope of Work

Deliverables, revision rounds, file formats, turnaround times, and other specifics are set out in the applicable Project Agreement or written order confirmation. Verbal agreements are not binding. Any changes to the agreed scope of work must be made in writing and may result in additional costs and revised delivery timelines.

3.2 Revisions

Each project includes the number of revision rounds specified in the applicable Project Agreement. A revision is defined as changes that fall within the originally agreed scope and briefing. Changes that constitute a material departure from the original briefing, or that arise as a result of changes to client instructions after work has commenced, may be treated as additional work and invoiced separately.

3.3 File Delivery

Completed files will be delivered in the formats and via the channels specified in the Project Agreement (e.g., email, download link, cloud storage). AR Buildings shall not be liable for delays caused by the client's failure to provide required materials, feedback, or approvals within agreed timeframes.

3.4 Client-Provided Materials

You are responsible for ensuring that all materials submitted to AR Buildings (including photographs, architectural drawings, floor plans, brand assets, and other content) are either your property or that you have obtained all necessary rights and permissions to provide them for use in delivering the Services. By submitting materials, you grant AR Buildings a limited, non-exclusive, royalty-free licence to use, reproduce, and process those materials solely for the purpose of delivering the agreed Services.

4. Fees, Payment, and Refunds

4.1 Pricing

All prices are set out in the applicable quotation, order confirmation, or on the pricing page of our website. Prices are stated in Euros (EUR) and are exclusive of VAT unless otherwise stated. VAT will be applied in accordance with applicable German and EU law.

4.2 Payment Terms

Unless otherwise agreed in writing, invoices are due and payable within 14 days of the invoice date. For new clients or larger projects, AR Buildings may require an advance payment of up to 50% of the total project value before work commences. Payment instructions are included with each invoice.

4.3 Late Payment

In the event of late payment, AR Buildings reserves the right to charge statutory default interest in accordance with § 288 of the German Civil Code (BGB) and to suspend work on ongoing projects until outstanding amounts have been settled.

4.4 Refunds

Due to the bespoke and custom nature of our Services, we do not offer refunds once work has commenced. If AR Buildings is unable to deliver the agreed Services due to our own fault, we will offer either remedial performance or a pro-rated refund. Statutory consumer rights under applicable German and EU law remain unaffected.

4.5 Cancellation

If you wish to cancel a project after work has commenced, you will be liable for the costs of work performed up to the point of cancellation. Cancellations must be communicated to us in writing.

5. Intellectual Property and Licences

5.1 Ownership of Deliverables

Unless expressly agreed otherwise in a Project Agreement, upon receipt of full payment AR Buildings grants the client a non-exclusive, perpetual, and worldwide licence to use the delivered visual materials for the purposes specified in the Project Agreement (e.g., property marketing, online listings, print advertising). AR Buildings retains all underlying intellectual property rights in the deliverables, including the right to use them in our portfolio, on our website, and in marketing materials, unless the client requests otherwise in writing before or during the project.

5.2 AR Buildings Brand and Materials

All copyrights, trademarks, logos, trade names, trade secrets, patents, and other intellectual property rights relating to AR Buildings and our Services are and shall remain the exclusive property of AR Buildings GmbH or our licensors. You may not use our trademarks, logos, or branding materials in any form without our prior written consent.

5.3 Your Licence to AR Buildings

To the extent necessary to provide our Services, you grant AR Buildings a worldwide, non-exclusive, royalty-free licence to use, reproduce, adapt, and process any content and materials you submit through our Services. This licence is strictly limited to the delivery of the Services and the purposes described in these Terms.

5.4 Feedback

If you provide feedback, suggestions, or ideas regarding our Services, you grant AR Buildings an irrevocable, royalty-free, worldwide licence to use such feedback for any purpose, without any obligation to compensate you or attribute authorship.

5.5 Portfolio Use

You agree that AR Buildings may showcase completed project deliverables in our portfolio and marketing materials. If you require confidentiality regarding a specific project, please notify us in writing before or during the project; we will honour such requests.

5.6 Reporting Intellectual Property Infringements

If you believe that content on our website or provided through our Services infringes your intellectual property rights, please contact us in writing at info@ar-buildings.com with full details of the alleged infringement. We will review all legitimate notices and respond accordingly.

6. Privacy and Data Protection

AR Buildings places great importance on the protection of your personal data. Our collection, use, storage, and disclosure of personal data is governed by our Privacy Policy, available at www.ar-buildings.com/privacy, which forms part of these Terms.

As a company headquartered in Berlin, Germany, AR Buildings processes personal data in accordance with the General Data Protection Regulation (GDPR) (EU) 2016/679 and applicable German data protection law (Bundesdatenschutzgesetz, BDSG). By using our Services, you acknowledge our data processing practices as described in the Privacy Policy.

Personal data you provide to us will only be processed as described in our Privacy Policy and to the extent necessary for the delivery of the Services and compliance with our legal obligations. 7. Acceptable Use

7.1 Lawful Use

You may only use our Services for lawful and legitimate purposes. You agree not to use our Services to: (a) violate any applicable laws, regulations, or the rights of third parties; (b) submit, transmit, or display content that is illegal, defamatory, obscene, threatening, abusive, racially or ethnically offensive, or otherwise objectionable; (c) impersonate any person or organization or misrepresent your affiliation with any person or organization; (d) submit false or misleading information; or (e) engage in activities that disrupt or impair our Services or related infrastructure.

7.2 Prohibited Technical Use

Without our prior written consent, you are prohibited from: (a) copying, modifying, distributing, selling, or renting any part of our Services or related software; (b) reverse engineering or attempting to extract the source code of any software forming part of our Services; (c) using automated tools, bots, or scrapers to access or collect data from our website; (d) transmitting or introducing malicious code, viruses, ransomware, or other harmful material through our Services; or (e) attempting to gain unauthorized access to any systems, accounts, or data associated with our Services.

7.3 Account Security

You are responsible for maintaining the security of your device and your AR Buildings account. You must notify us immediately of any unauthorized use or security breach affecting your account or our Services.

8. Third-Party Services

Our website and Services may contain links to or integrations with third-party websites, tools, or services (e.g., payment processors, cloud storage providers, communication platforms). AR Buildings is not responsible for the content, practices, or policies of third-party services. Your use of third-party services is subject to their own terms and conditions and privacy policies.

We do not endorse any third-party services and make no warranties or representations with respect to them. If you experience issues with a third-party service integrated into our workflow, please contact that service's support directly.

9. Disclaimer of Warranties

Our Services are provided "as is" and "as available". To the fullest extent permitted by applicable law, AR Buildings makes no express or implied warranties regarding our Services, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our website will be available at all times, error-free, or free from viruses or other harmful components.

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without prior notice. To the extent that mandatory statutory warranties apply under German or EU consumer protection law, such warranties are not excluded by this disclaimer and remain fully in effect.

10. Limitation of Liability

10.1 General Limitation

To the fullest extent permitted by applicable law, AR Buildings shall not be liable for indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of profits, loss of data, or loss of goodwill, arising out of or in connection with your use of our Services.

10.2 Cap on Liability

The total aggregate liability of AR Buildings to you for all claims arising out of or in connection with these Terms or our Services shall not exceed the total amount paid by you to AR Buildings in the 12 months preceding the event giving rise to the claim.

10.3 Mandatory Statutory Rights

Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence (§ 276 BGB); (b) damage caused intentionally or through gross negligence; (c) fraudulently concealed defects; or (d) any other liability that cannot be excluded or limited under applicable mandatory German or EU law. If you are a consumer, your statutory rights under German consumer protection law (including warranty rights under §§ 437 et seq. BGB) remain unaffected.

11. Term and Termination

These Terms apply for as long as you use our Services. Either party may terminate a specific project or service engagement as set out in the relevant Project Agreement.

AR Buildings reserves the right to suspend or terminate your access to our Services, including your account, at any time with reasonable notice if you breach these Terms or if we are required to do so by law. In the event of a serious or repeated breach, immediate termination without notice is permissible.

Upon termination of any project or these Terms, the following provisions shall survive: Section 5 (Intellectual Property and Licences), Section 4 (Fees, Payment, and Refunds) with respect to outstanding payment obligations, Section 10 (Limitation of Liability), and Section 12 (Governing Law and Dispute Resolution).

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms and any disputes arising out of or in connection with them or your use of our Services shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and any German private international law rules that would result in the application of a different legal system.

12.2 Jurisdiction

The courts of Berlin, Germany shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms, subject to any mandatory provisions of applicable consumer protection law that confer jurisdiction on the courts of the consumer's habitual residence.

12.3 EU Online Dispute Resolution

The European Commission provides an online dispute resolution (ODR) platform, accessible at https://ec.europa.eu/consumers/odr. AR Buildings is not obligated to participate in alternative dispute resolution proceedings before a consumer arbitration board, but we will always endeavour to resolve disputes amicably and in good faith.

13. General Provisions

13.1 Amendments

AR Buildings reserves the right to amend these Terms at any time. We will notify you of material changes by updating the "Last modified" date at the top of these Terms and, where appropriate, by direct notification via email or a notice on our website. Your continued use of our Services following any such amendment constitutes your acceptance of the updated Terms. If you do not agree with the amended Terms, you must discontinue use of our Services.

13.2 Severability

If any provision of these Terms is found by a competent court or authority to be unlawful, invalid, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

13.3 Waiver

Failure by AR Buildings to enforce any provision of these Terms at any given time shall not constitute a waiver of our right to enforce such provision in the future. No waiver shall be effective unless made in writing.

13.4 Assignment

AR Buildings may assign its rights and obligations under these Terms to a successor entity in the context of a merger, acquisition, restructuring, or sale of assets, without your consent but with prior notification. You may not assign your rights or obligations under these Terms without our prior written consent.

13.5 Entire Agreement

These Terms, together with our Privacy Policy and any applicable Project Agreement, constitute the entire agreement between you and AR Buildings regarding your use of our Services and supersede all prior agreements, representations, and understandings.

13.6 Language

These Terms are provided in English. Where translations into other languages are made available (including automated translations on our website), the English version shall prevail in the event of any inconsistency or ambiguity.

13.7 Export Controls

You agree to comply with all applicable export control laws and trade sanctions of the Federal Republic of Germany and the European Union. You represent that you are not located in a country subject to an EU embargo or otherwise prohibited from receiving our Services, and that you are not listed on any EU or German government restricted-party list.
